The Trial of Wasim Al-Assad Reveals Flaws in Syria’s Justice System

Damascus, Syria: August 18, 2026

“The Syrian public deserves trials against Assad officials that are credible, strengthen the rule of law, and expose the crimes of the past; the trial against Wassim Al-Assad failed to achieve any of these ideals,” said the Syria Justice and Accountability Centre after it was announced that Wasim Al-Assad was found guilty of premeditated murder, murder accompanied by torture and brutality, and crimes classified as crimes against humanity and war crimes, and sentenced to death today in Damascus. SJAC added, “the conviction comes a week after the trial of Atef Najib which further demonstrated that Syria’s legal system and penal code lack the legal framework to fully litigate crimes committed during the conflict.”

SJAC’s trial monitoring team attended each day of the proceedings and documented several structural flaws that harm the credibility of the final ruling. “Our monitors noted that witness testimony was rushed and evidence presented by the prosecution failed to directly connect Wasim Al-Assad to the crimes he was accused of committing. Additionally, Wasim Al-Assad’s court appointed lawyer failed to provide an adequate defense,” said SJAC, adding “the ineffectiveness of Wasim Al-Assad’s defense raises major concerns about fair trials for former officials particularly now that the court has imposed a death sentence.”

Wasim Al-Assad, cousin to former president Bashar Al-Assad, was charged with multiple crimes including forming armed militias, drug trafficking, and participating directly or indirectly in operations that led to the Al-Maliha massacre. He is the second Assad-era official to be found guilty for his role in the Syrian conflict.

“The Syrian people deserve to know the true extent of the crimes committed against them during the Syrian conflict,” said Mohammad Al Abdallah, Executive Director of the Syria Justice and Accountability Centre, “this trial failed to reveal the truth of Wasim Al-Assad’s crimes or the crimes of the former government. As a result, it also failed to deliver meaningful justice to victims and their families.”

SJAC will provide a full analysis of this trial and the trial of Atef Najib here, in the coming weeks.
